Welcome to RecallSeeker ("RecallSeeker," "we," "us," or "our"). These Terms of Service ("Terms") govern your access to and use of the RecallSeeker website, applications, APIs, and related services (collectively, the "Services") available at recallseeker.com.
By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, do not use the Services.
1. Purpose of RecallSeeker
RecallSeeker provides tools for recall discovery, contextual search, classification, analysis, and workflow modeling related to consumer products, safety events, regulatory notices, and related datasets. The Services may include AI-assisted features, visual graph editors, data enrichment, and reporting tools.
RecallSeeker is an information and decision-support platform. It does not provide legal, regulatory, medical, or compliance advice.
2. Beta Disclaimer
Some features of the Services are currently in beta or preview. Beta features are provided for testing, evaluation, and feedback purposes and may be incomplete, unstable, or subject to change. We make no guarantees of performance, availability, or accuracy for beta features, and your use is at your own risk.
3. Eligibility
You must be at least 18 years old and capable of forming a binding contract to use the Services. By using the Services, you represent and warrant that you meet these requirements.
If you use the Services on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
4. Accounts and Access
4.1 Account Registration
Some features require creating an account. You agree to provide accurate, current, and complete information and to keep it updated.
4.2 Account Security
You are responsible for safeguarding your credentials and all activity occurring under your account. Notify us immediately of any unauthorized use or security breach.
4.3 Account Suspension or Termination
We may suspend or terminate access to the Services at any time if you violate these Terms, misuse the Services, or if required by law.
5. Acceptable Use
You agree not to:
- Use the Services for unlawful, deceptive, or fraudulent purposes
- Attempt to reverse engineer, scrape, or extract source code, models, or proprietary datasets except as expressly permitted
- Interfere with or disrupt the integrity, security, or performance of the Services
- Upload or transmit malware, harmful code, or abusive content
- Misrepresent RecallSeeker outputs as authoritative legal or regulatory determinations
6. Data, AI, and Outputs
6.1 Data Sources
RecallSeeker aggregates and processes data from public, licensed, and user-provided sources. We do not guarantee completeness, accuracy, or timeliness of any dataset.
6.2 AI-Assisted Features
Certain features use machine learning or artificial intelligence to generate classifications, summaries, recommendations, or workflows.
You acknowledge that:
- AI outputs are probabilistic and may contain errors
- Outputs are provided for informational purposes only
- Human review is required before relying on any output for compliance, safety, or enforcement decisions
6.3 Ownership of Outputs
As between you and RecallSeeker:
- You own your user-provided inputs
- You may use generated outputs for internal or commercial purposes, subject to these Terms
- RecallSeeker retains all rights in the underlying models, systems, and platform logic
7. User Content
You retain ownership of content you upload or submit to the Services ("User Content"). By submitting User Content, you grant RecallSeeker a non-exclusive, worldwide, royalty-free license to use, process, host, and display it solely to operate and improve the Services.
You represent that you have all rights necessary to submit User Content and that it does not violate any law or third-party rights.
8. Enterprise and API Customers
For organizations using RecallSeeker via APIs, integrations, or enterprise accounts:
- Enterprise/partner accounts may have custom agreements, usage limits, SLAs, and data handling terms.
- API keys and integrations must be used according to the assigned permissions and rate limits.
- Enterprise customers are responsible for securing API credentials and controlling access to their internal teams.
- Custom enterprise services may include additional confidentiality, data processing, and compliance obligations as outlined in separate agreements.
These Terms apply unless superseded by a mutually executed enterprise agreement.
9. Third-Party Services
The Services may integrate or link to third-party tools, datasets, or services. RecallSeeker is not responsible for third-party content, availability, or practices. Your use of third-party services is governed by their respective terms.
10. Fees and Subscriptions
Certain features may require payment. Pricing, billing cycles, and subscription terms will be disclosed at the time of purchase or in a separate agreement.
Unless otherwise stated:
- Fees are non-refundable
- Taxes are your responsibility
11. Confidentiality
Non-public information disclosed by RecallSeeker, including platform architecture, roadmap details, and proprietary workflows, is confidential and may not be disclosed without our consent.
12. Privacy and Data Processing
Your use of RecallSeeker is subject to our Privacy Policy and Data Processing Addendum, which outline how we collect, store, process, and protect your data. By using the Services, you agree to the terms in those documents.
13. Disclaimers
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, RECALLSEEKER DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
WE DO NOT WARRANT THAT THE SERVICES WILL BE ERROR-FREE, UNINTERRUPTED, OR COMPLETE.
14. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, RECALLSEEKER SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF DATA, PROFITS, OR BUSINESS INTERRUPTION.
OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATED TO THE SERVICES SHALL NOT EXCEED THE AMOUNT PAID BY YOU TO RECALLSEEKER IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.
15. Indemnification
You agree to indemnify and hold harmless RecallSeeker and its officers, directors, employees, and affiliates from any claims, damages, liabilities, and expenses arising out of your use of the Services or violation of these Terms.
16. Governing Law and Venue
These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles. Any legal action must be brought in state or federal courts located in California.
17. Changes to These Terms
We may update these Terms from time to time. Changes will be effective when posted. Your continued use of the Services constitutes acceptance of the revised Terms.
18. Termination
You may stop using the Services at any time. We may terminate or suspend your access with or without notice if you violate these Terms or if the Services are discontinued.
